888 Holdings moves to German Federal Constitutional Court

888 Holdings has announced that it is filing a constitutional complaint regarding last year’s decision on online gaming by the Federal Administrative Court in Leipzig. The Court ruled in October 2017 that the ban on online gambling, including on online casinos, is constitutional and therefore permissible.

888 Holdings has licenses in Gibraltar and the UK. These so-called EU licenses entitle them to offer services in other member states as well.

Constitutional complaints are such a complicated legal remedy that only a fraction of applications are approved.

In December 2017, the European Commission announced in Brussels that it would close various cases against Member States in the field of gambling legislation.

The Commission emphasized that the decision not to proceed was not the equivalent of an endorsement of the respective national laws, but that other interests should be given preference. The national courts, it said, should continue to deal with such cases.
