Cherry Hill Towne Center cited the impact of the COVID-19 pandemic and resulting government restrictions in mothballing its project “at least for the foreseeable future,” U.S. District Judge Renee Marie Bumb said in a ruling Thursday. The judge approved the developer’s request to drop its lawsuit against GS Park Racing, the track’s former operator. GSPR contends a restrictive covenant on the property gives it the exclusive right to offer gambling at the site. Cherry Hill Towne Center’s lawsuit sought a court ruling that the covenant was unenforceable.
